The Facts
On Wednesday, the Biden administration requested the Supreme Court consider its bid to end the Migrant Protection Protocols (MPP), also known as the “Remain in Mexico” policy.
The filing asks the Supreme Court to rule on whether Department of Homeland Security (DHS) Secretary Alejandro Mayorkas is required to implement the Trump-era policy.
The MPP bars asylum seekers from Central America entering the US while their claims are considered in immigration courts.
Upon taking office, the Biden administration suspended the MPP. However, they were then ordered by a TX district judge to reinstate the policy.
In October, Mayorkas issued a memo announcing the DHS’s intent to terminate the policy. A federal appeals court blocked the directive.
