The Facts

On Tuesday, the Biden administration filed a petition with a federal appeals court in Cincinnati to reinstate the national mandate requiring companies to ensure that their employees are vaccinated.

The 5th US Circuit Court of Appeals had stayed the Occupational Safety and Health Administration (OSHA) rules the day after publication on November 5th.

The OSHA rule requires businesses with over 100 employees to either maintain a fully vaccinated workforce or to ensure that the unvaccinated remain masked and produce a negative Covid report once a week.

Over 34 lawsuits by employers and Republican-controlled states against the OSHA rules have been moved to the Sixth Circuit Appeals Court for consolidation.

In its 52-page motion filed on Tuesday, the government said that companies seeking the stay couldn’t show that “their claimed injuries outweigh the interest in protecting employees from a dangerous virus while this litigation proceeds.”
